General Terms and Conditions (Accommodation Agreement)

(hereinafter "the T&Cs")

1. Scope
These T&Cs apply to the temporary and remunerated provision of rooms and related services at Riad Nyla, as well as any additional services arranged during the Guest’s stay.
Any terms conflicting with these T&Cs are only valid if explicitly agreed in writing by Riad Nyla.

2. Contractual Partners
The contractual partners are the company MS WELLNESS AND SPA SARL, managed by M. Sc. Chiara Toffoli, and the customer (hereinafter referred to as "Guest").

3. Formation of the Contract
The contract is established upon receipt of a booking confirmation from Riad Nyla. Any changes or cancellations are governed by these T&Cs.
If a third party makes a booking on behalf of the Guest, both the Guest and the third party are jointly responsible for meeting all obligations arising from the agreement.

4. Prices and Taxes
Room rates are listed in Euros (EUR) and include VAT.
The Moroccan tourist tax (€3.00 per person, per day) is not included and must be settled at check-out.

5. Payment and Guarantee
A valid credit card is required to secure all bookings.
For advance payments, 100% of the total cost is due as outlined in the booking confirmation (usually fourteen days before arrival).

6. Security and Payment Gateway
Our payment gateway is fully secure and protected with necessary encryption and security measures. Payments are processed through Centre Monétique Interbancaire.

7. Check-In and Check-Out

Check-in: Check-in time is at 3 PM on the day of arrival.
Check-out: Check-out must be done by 11 AM on the day of departure.
8. Cancellation Policy
Cancellations must be made by 12:00 PM at least 14 days before arrival.
Late cancellations or no-shows will incur a fee equal to the total booking amount.
All bookings are confirmed via email, and only a written confirmation is considered a firm booking after the reception of payment.
Cancellations must be submitted in writing (via email or fax). Bookings canceled by phone will not be valid unless followed by a written cancellation. Failure to comply with this procedure may result in the cancellation charges outlined above.

9. Guest Responsibilities
Guests must use the room and facilities as intended. Any damage caused intentionally or through negligence will be charged to the Guest.

10. Liability of Riad Nyla
Riad Nyla assumes no responsibility for any damages or losses incurred by guests during their stay.
Personal belongings, including valuables and cash, are stored entirely at the owner's risk.

11. Customs and Legal Requirements
It is your responsibility to ensure that you have the necessary travel documents, including a valid passport, to enter Morocco.
If you are denied entry upon arrival, any deposit paid will be forfeited. Please consult with the relevant authorities regarding the visa requirements and other legal matters.

12. Personal Data Protection
We take the privacy and protection of your personal data seriously. We collect personal information from visitors to our website through enquiry and reservation forms, and any information you provide by email.
We may also collect information about your visit to our website, such as your IP address and browser details.
This information will be used to communicate with you about your booking and may also be used for marketing purposes. You may opt out of marketing communications at any time by contacting us.
We will never share your personal data with third parties unless required by law or if we transfer ownership of our services to another company.

14. Changes to Terms and Conditions
We reserve the right to amend these terms and conditions at any time. Any changes will be posted on this page and will become effective immediately.
By continuing to use our website or making a booking, you agree to these terms and conditions.

15. Final Provisions
Moroccan law governs all agreements.
The place of jurisdiction for disputes is Marrakech.
